These Terms and Conditions (“Terms”) constitute an electronic record under the Information Technology Act, 2000 and applicable rules. This electronic record is generated by a computer system and does not require physical or digital signatures.
About Us
Bhavishyat.Org (the “Platform”) is owned and operated by Mystic Oracle Visions LLP (“Company”, “we”, “us”, “our”). By accessing or using the Platform, creating an account, placing an order, subscribing, or submitting information, you agree to be bound by these Terms and our Privacy Policy.
1) 🔖 Scope and Acceptance
- These Terms apply to all visitors, users, customers, and subscribers.
- You must read these Terms before using the Platform. Continued use means acceptance.
- If you do not agree, you must stop using the Platform.
2) 🧒 Age Restriction
- Our services are intended for persons aged 18 years or above.
- If you are under 18, you may use the Platform only under the supervision and verifiable consent of a parent/legal guardian, and any submissions (including photos) must be made by the guardian.
3) 🔮 Nature of Services
- We provide interpretative and advisory services including (as offered from time to time): Vedic astrology, horoscope/Kundli analysis, palm analysis, signature analysis, numerology, Vaastu consultation, face/photo reading, spiritual guidance, and related consultation services (“Services”).
- The Services are guidance-based and interpretative in nature. They are not medical, legal, psychiatric, or other professional advice.
- If you need medical, legal, financial, or mental health advice, consult qualified professionals.
4) 🧾 User Accounts and Information
- You agree to provide accurate details for service delivery (such as name, email, phone, birth details where relevant).
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
5) 📦 Service Delivery (Reports/Consultations)
- Typical delivery timeline for reports/consultations is 7–10 days from (a) successful payment and (b) receipt of complete required inputs.
- Delivery timelines may change during peak demand, festivals, technical downtime, or force majeure events. In such cases, we may notify you via email/WhatsApp/SMS.
- If essential inputs are incomplete or inconsistent, delivery time will extend until the required information is received.
6) 📸 Photo Submission & Analysis Policy
- Consent & Rights: You must have the legal right and authorization to submit any photo/image/video you upload. For minors, verifiable parent/guardian consent is mandatory.
- Usage: Submitted media is used only to provide the requested Service. We do not publicly publish your personal photos.
- Internal improvement: If anonymised samples are used for internal training/research/quality improvement, identifying elements will be removed and, where required, additional consent will be obtained.
- Retention & Deletion: We retain submitted media and related data only as long as necessary to provide the Service and comply with legal/accounting/audit obligations. Standard retention (unless longer required by law or for dispute resolution) is up to 12 months from service completion, after which data may be deleted or anonymised.
- Prohibited Content: Do not upload illegal, explicit sexual content, hate content, impersonation content, stolen/private media, or content violating any third-party rights.
- Indemnity: You are solely responsible for what you upload and agree to indemnify us against claims arising from unlawful or unauthorized uploads.
7) 💳 Pricing, Payments, and Taxes
- Prices are shown on the Platform and may change without prior notice.
- Payments are processed through third-party payment gateways/banks. We do not store full card/bank credentials.
- Taxes (GST or other levies) will be applied where applicable and shown at checkout/invoice.
8) 🔁 Subscriptions (Auto-Renew)
- If you purchase a subscription plan, you authorize us (and our payment partners) to charge the subscription fee on a recurring basis until you cancel (“Auto-Renew”).
- Your subscription renews automatically at the end of each billing period (for example, annual), unless cancelled before renewal.
- Cancellation: You may cancel auto-renew from your account/dashboard (if enabled) or by emailing [email protected] with your registered email/phone. Cancellation stops future renewals and takes effect at the end of the current paid term, unless otherwise stated on the plan page.
- Failed/Delayed Charges: If a renewal charge fails, access may be paused until payment is successful. We may retry charges as per payment gateway rules.
- Benefits, access limits, and inclusions are as described on the relevant plan page. Misuse may lead to suspension.
9) 🚫 Refund, Cancellation, and No-Refund-After-Delivery Policy
- Digital/consultation services involve time, expertise, and custom work.
- No refund will be provided after the report/consultation has been delivered or the service has been substantially performed.
- Refunds may be considered only in limited cases, such as:
- Duplicate payment for the same order,
- Payment deducted but order not created due to technical error (subject to verification),
- Non-delivery beyond a reasonable time due solely to our fault (excluding cases where user inputs are incomplete).
- Any approved refund will be processed to the original payment method, subject to gateway/bank timelines.
- If you initiate a chargeback without contacting us first, we may suspend your account and require additional verification for future orders.
10) 🛑 Prohibited Use of Platform
- You must not use the Platform for unlawful, fraudulent, abusive, or harmful purposes.
- You must not attempt unauthorized access, scraping, hacking, or interference.
- You must not upload viruses/malware.
- You must not copy, resell, redistribute, or commercially exploit Platform content without written permission.
11) 🧾 Intellectual Property
- All content, tools, text, graphics, logos, methodologies, reports/templates, and deliverables are owned by Mystic Oracle Visions LLP or licensors.
- You receive a limited, non-transferable, non-exclusive right to access purchased content for personal use only.
- Reproduction, redistribution, resale, public posting, or commercial use without written permission is strictly prohibited.
12) ⚠️ Disclaimers on Outcomes and Accuracy
- Astrology and allied interpretative sciences are probability-based and depend on multiple variables. No guarantees of outcomes are provided.
- Your decisions remain your responsibility. We are not responsible for actions taken based on the Services.
13) ⚖️ Limitation of Liability
- Services are provided “as-is” and “as-available”.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim shall not exceed the amount paid by you for the specific Service giving rise to the claim.
14) 🛡️ Privacy, Data Protection, and Cookies
- Personal data is handled as described in our Privacy Policy, in line with applicable Indian data protection law.
- We use cookies/analytics to improve user experience and site performance. You may manage cookies through your browser settings, though some features may not work properly.
15) 📧 Marketing Communications
- You may receive transactional communications related to your orders/subscription (order updates, delivery, renewals).
- Promotional messages (offers/newsletters) may be sent where you have opted in or where permitted by law.
- You can opt out of promotional communication anytime by emailing [email protected] or using the unsubscribe option (where available).
16) 📌 Grievance Redressal (Consumer Support)
We maintain a grievance redressal mechanism for customer support and complaint handling.
17) 🔁 Modifications
- We may update these Terms from time to time. Updated Terms will be posted on the Platform with a revised Effective Date.
- Your continued use after updates constitutes acceptance.
18) 🧩 Severability
If any provision of these Terms is held unenforceable, the remaining provisions will remain valid and enforceable.
19) 📍 Governing Law, Dispute Resolution, and Jurisdiction
- Governing Law: These Terms shall be governed by the laws of India.
- First Step: Disputes should first be raised to [email protected] for amicable resolution.
- Arbitration: If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. Seat/Venue: Bhopal, Madhya Pradesh (India). Arbitrator: Sole arbitrator appointed by the Company, with due process. Language: English.
- Courts: Subject to arbitration, courts at Bhopal shall have exclusive jurisdiction.
20) 📂 Ownership, Distribution, and Misuse of Company Content
- Delivered Content: All delivered reports/content are for personal use only. Sharing, publication, redistribution, or commercial use is prohibited without written permission.
- Social Media Content: Content from our official channels (Facebook, X/Twitter, Instagram, YouTube, WhatsApp, Telegram, etc.) is protected. Unauthorized reproduction or commercial use may result in legal action.
